Reasons for the decision

 

3.1       A considerable amount of evidence was produced to the Registration Authority and there are a number of issues in dispute. The Panel considered it was necessary to hold an inquiry to satisfactorily consider and test the evidence.

 

3.2       RESOLVED (1) to agree, on the basis of representations made since the publication of the report, to note that the report published on 17 May 2011 had been withdrawn;

 

(2) to agree to defer the decision on whether to register land at Fern Road, St Leonards on Sea as a town or village green pursuant to section 15 of the Commons Act 2006 until after the outcome of a non statutory public inquiry; and

 

(3) agree to refer the application  to register to a public inquiry.

4.1       The Panel considered a report by the Assistant Director, Legal and Democratic Services.

 

Reasons for the Decision

 

4.2       The Panel concluded that there was sufficient supporting evidence to satisfy the statutory tests.

 

4.3       RESOLVED - to accept the application, pursuant to section 15 of the Commons Act 2006, by Herbrand Walk Beach Preservation Society for the land at Herbrand Beach, Cooden, Bexhill-on-Sea be registered as a town or village green.
